These terms and conditions (“Terms”) govern your use of the Pinch App (“App”), provided by Pinch UG registered in Berlin, Germany.
1. App Usage
1.1 The Pinch Event App is intended solely for use in organising, managing, and participating in events and activities.
2. Registration
2.1 In order to use certain features of the App, you may be required to register for an account. You agree to provide accurate and complete registration information and to keep your account information updated.
2.2 You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use of your account or any other breach of security.
3. Content
3.1 You are solely responsible for any content, including event information, text, images, videos, and other materials (“Content”) that you upload, submit, or display through the App.
3.2 You warrant that you have the necessary rights to use and share any Content you upload or submit through the App and that such Content does not violate any third-party rights or applicable laws.
3.3 We reserve the right to remove or refuse any Content that, in our sole discretion, violates these Terms or is otherwise inappropriate or objectionable.
4. Privacy
4.1 Your use of the App is subject to our Privacy Notice, which outlines how we collect, use, and disclose your personal information. By using the App, you consent to our Privacy Policy.
5. Termination
5.1 We reserve the right to suspend, terminate, or restrict your access to the App at our sole discretion, without prior notice, for any reason, including, but not limited to, violation of these Terms or applicable laws.
6. Limitation of Liability
6.1 To the extent permitted by applicable law, we shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the App, (b) any unauthorised access to or use of our servers and/or any personal information stored therein, (c) any interruption or cessation of transmission to or from the App, or (d) any bugs, viruses, trojan horses, or the like that may be transmitted to or through the App by any third party.
7. Modifications to Terms
7.1 We reserve the right to modify or update these Terms at any time. The most current version of the Terms will be posted on the App. Your continued use of the App after any changes to the Terms constitutes your acceptance of the revised Terms.
8. Governing Law
8.1 These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law principles.
